1. Service Description

Phasea is a circadian rhythm optimization tool designed to help users track, understand, and optimize their sleep patterns and circadian health. The service provides features including sleep logging, psychomotor vigilance testing (PVT), travel adaptation planning, and personalized recommendations based on your circadian profile.

Our service analyses your sleep data, travel schedules, and test results to provide guidance on optimizing your circadian rhythm for better performance, alertness, and wellbeing.

2. Medical Disclaimer

IMPORTANT: Phasea does not provide medical advice, diagnosis, or treatment. The information and recommendations provided by this service are for informational and educational purposes only.

The content provided through Phasea, including but not limited to sleep recommendations, light exposure guidance, and circadian optimization suggestions, should not be considered a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or sleep disorder.

Never disregard professional medical advice or delay in seeking it because of something you have read or received through this service. If you think you may have a medical emergency, call your doctor or emergency services immediately.

3. Not for Emergency Use

Phasea is NOT designed for use in medical emergencies. Do not use this service to address urgent health concerns.

If you are experiencing a medical emergency, including but not limited to severe sleep deprivation affecting your ability to function safely, symptoms of a sleep disorder, or any other urgent health concern, please contact emergency services or seek immediate medical attention.

This service is intended for general wellness and optimization purposes only and should never be relied upon in situations requiring immediate medical intervention.

4. Limitation of Liability

To the fullest extent permitted by applicable law, Phasea and its operators, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your access to or use of (or inability to access or use) the service
  • Damages resulting from any conduct or content of any third party on the service
  • Damages resulting from unauthorized access, use, or alteration of your transmissions or content
  • Any decisions made or actions taken based on information provided by the service

In no event shall our total liability to you for all claims exceed the amount you have paid us in the twelve (12) months prior to the claim, or £100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

5. Beta Service Terms

Phasea is currently in beta testing. The service is provided "as is" and "as available" without warranties of any kind.

As a beta service, you acknowledge and agree that:

  • No Uptime Guarantees: We do not guarantee that the service will be available at all times or that it will be uninterrupted, timely, secure, or error-free.
  • Service Changes: Features, functionality, and the overall service may change, be modified, or be discontinued at any time without prior notice.
  • Data Resets: During the beta period, user data may be reset or deleted as part of testing and development processes. We recommend exporting your data regularly.
  • No Warranties: We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of any information or recommendations provided.
  • Feedback: Any feedback, suggestions, or ideas you provide about the service may be used by us without any obligation to compensate you.

6. Account Termination

6.1 Your Right to Terminate

You may terminate your account at any time by using the account deletion feature in your settings or by contacting us. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

6.2 Our Right to Terminate

We reserve the right to suspend or terminate your account and access to the service at our sole discretion, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms of Service
  • Violation of the Acceptable Use Policy
  • Conduct that we determine to be harmful to other users or the service
  • Extended periods of inactivity
  • Discontinuation of the service

6.3 Effect of Termination

Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms of Service or their subject matter or formation (including non-contractual disputes or claims).

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence.

8. Acceptable Use Policy

When using Phasea, you agree to use the service responsibly and in compliance with all applicable laws. You agree NOT to:

  • Use the service for any unlawful purpose or in violation of any applicable local, national, or international law
  • Attempt to gain unauthorized access to the service, other user accounts, or computer systems or networks connected to the service
  • Interfere with or disrupt the service or servers or networks connected to the service
  • Use any automated means, including robots, crawlers, or scrapers, to access the service or collect data
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
  • Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Use the service to transmit any viruses, worms, or other malicious code
  • Attempt to reverse engineer, decompile, or disassemble any portion of the service
  • Share your account credentials with others or allow others to access your account
  • Use the service in any manner that could damage, disable, overburden, or impair the service

Violation of this Acceptable Use Policy may result in immediate termination of your account without prior notice.

9. Changes to Terms

We reserve the right to modify these Terms of Service at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, provide additional notice (such as adding a statement to our homepage or sending you a notification).

Your continued use of the service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue your use of the service.
